Terms of Use
These Terms of Use (“Terms”) govern your access to and use of Market Insight (the “Service”), operated by High Holly Ltd, a private limited company registered in England & Wales under company number 06531629. By creating an account or using the Service you agree to these Terms.
1. About the service
Market Insight provides real-time market dashboards, macro indicators, sentiment data, AI-generated market briefings, and optional brokerage portfolio tracking. The Service is provided for informational and educational purposes only and does not constitute investment, tax, legal, or financial advice, nor a personal recommendation to buy, sell or hold any security.
The Service is operated by High Holly Ltd (company no. 06531629, registered in England & Wales). In these Terms “we”, “us” and “our” refer to High Holly Ltd.
Brand & domain notice: The product is called Market
Insight and is served from the domain marketrecapdaily.com. Any
reference to one applies to the other.
2. Your account
- You must be at least 18 years old and legally capable of entering into a contract.
- You agree to provide accurate information and to keep your sign-in credentials confidential.
- You are responsible for all activity under your account.
- Notify us immediately at support@marketrecapdaily.com if you suspect unauthorised access.
3. Brokerage connections and SnapTrade
Market Insight uses SnapTrade (Passiv Technologies Inc.) to connect to your brokerage account on a read-only basis. By initiating a connection you:
- Authorise SnapTrade to access your brokerage on your behalf and to share the resulting holdings, balances and transaction data with Market Insight.
- Confirm you have the right to grant that authorisation under your broker’s terms.
- Acknowledge that SnapTrade’s own terms (snaptrade.com/developer-terms-of-use) and privacy practices apply to the connection itself.
You can view and revoke any brokerage connection at any time on the Portfolio page. We do not currently place trades on your behalf; if a trading capability is added, it will require separate, explicit consent and a trade-preview flow showing all expected fees.
Data returned by SnapTrade and your broker may be delayed, incomplete, or temporarily unavailable. Market Insight does not guarantee real-time accuracy and is not liable for losses arising from data delays or gaps.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, or abusive purpose.
- Reverse-engineer, scrape, or attempt to gain unauthorised access.
- Resell, sublicense, or commercially exploit the Service without our prior written consent.
- Use the Service to violate any third-party rights, including your broker’s terms.
- Interfere with other users or with the integrity, security, or availability of the Service.
5. Plans and fees
The Service may include free and paid tiers. Pricing, included features, and billing terms for paid tiers will be presented before you subscribe. We may change pricing on prospective notice; existing prepaid periods are honoured.
6. Intellectual property
The Market Insight name, logo, dashboards, scoring methodologies (including MI Rank), copy and code are owned by us or our licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial use.
You retain ownership of content you create (notes, watchlists, manual entries). You grant us a worldwide, royalty-free licence to host and process that content solely to operate the Service.
7. Third-party services and data
The Service integrates third-party data providers (e.g. Financial Modeling Prep), authentication and storage (Supabase), brokerage connectivity (SnapTrade), AI providers, and hosting (Hostinger). We are not responsible for the acts, omissions, accuracy, or availability of third-party providers, and your use of their services may also be subject to their terms.
8. Financial information disclaimers
Risk warning — your capital is at risk. Investing in securities, funds, derivatives, foreign exchange, commodities and crypto-assets carries a high level of risk and may not be suitable for every investor. The value of your investments can go down as well as up and you may get back less than you put in. Past performance is not a reliable indicator of future results.
8.1 No advice, no recommendation, no solicitation
Market Insight publishes general market information, data visualisations, screens, technical indicators, sentiment metrics, news summaries and AI-generated market briefings (collectively, the “Content”). The Content is for informational and educational purposes only. Nothing on the Service constitutes, or should be construed as:
- investment, financial, trading, accounting, tax, pension or legal advice;
- a personal recommendation, solicitation, offer, invitation or inducement to buy, sell, hold, subscribe for, or otherwise transact in any security, fund, derivative, currency, commodity, crypto-asset or other financial instrument;
- an offer of securities or financial services to any person in any jurisdiction where such an offer would be unlawful;
- a guarantee, prediction, projection or forecast of future performance, price, yield or return.
You are solely responsible for your own investment decisions. We strongly recommend you seek independent, regulated professional advice appropriate to your circumstances before acting on any information you obtain from the Service.
8.2 Not regulated; not authorised
Market Insight is not authorised or regulated by the UK Financial Conduct Authority (FCA), the US Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), the European Securities and Markets Authority (ESMA), the Australian Securities and Investments Commission (ASIC), the Investment Industry Regulatory Organization of Canada (CIRO/IIROC) or any other financial-services regulator. The Service does not carry on any regulated activity within the meaning of the UK Financial Services and Markets Act 2000 (FSMA) or equivalent legislation in any other jurisdiction. No fiduciary, advisory, agency or other duty of care arises between you and us in connection with the Content.
8.3 Data accuracy, sources and AI output
Market and reference data is obtained from third-party providers (including, without limitation, Financial Modeling Prep, Polygon, exchange feeds, SnapTrade and your broker). Data may be delayed, incomplete, interrupted or incorrect, and we make no warranty as to its accuracy, completeness, timeliness or fitness for any purpose. Indicative prices are not executable quotes.
Some Content is generated or summarised by automated systems and large language models (“AI Content”). AI Content may contain factual errors, omissions, biases or fabricated references. You must independently verify any AI Content before relying on it.
8.4 Forward-looking statements
Any forward-looking statements — including outlooks, scenarios, projections, estimates, target prices or expressions of expectation — reflect views as at the date of publication only, are inherently uncertain and may not occur. We disclaim any obligation to update such statements.
8.5 Crypto-assets
Crypto-asset prices and analytics are displayed for information only. Crypto-assets are high-risk, largely unregulated investments. You should not invest in crypto-assets unless you are prepared to lose all the money you invest. Crypto-asset products are generally not covered by investor compensation schemes such as the UK Financial Services Compensation Scheme (FSCS) or the US Securities Investor Protection Corporation (SIPC).
8.6 “As is” basis
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted availability and freedom from error or malicious code.
9. Jurisdiction-specific notices
The Service is operated from the United Kingdom. By accessing the Service from outside the UK you do so on your own initiative and are responsible for compliance with local laws. The Service is not directed at, and may not be used by, any person in a jurisdiction where its publication or availability would be contrary to law or regulation, or would subject the operator to any registration or licensing requirement.
9.1 United Kingdom
The Content is a generic communication and is not a “financial promotion” within the meaning of section 21 FSMA. If any communication on the Service does constitute a financial promotion, it is intended only for persons in the UK who would qualify as exempt under the Financial Services and Markets Act 2000 (Financial Promotion) Order 2005 (e.g. investment professionals or high-net- worth individuals).
9.2 European Economic Area
The Content is not a marketing communication within the meaning of MiFID II, MiCA or the Prospectus Regulation. It is not directed at retail clients in any EEA member state where its publication would require local authorisation, translation or registration.
9.3 United States
Market Insight is not a registered investment adviser, broker-dealer, swap dealer, commodity pool operator or commodity trading adviser. The Service is not directed at “US persons” for the purposes of Regulation S under the US Securities Act of 1933, and no securities are being offered or sold to any US person through the Service. US users may connect a US brokerage via SnapTrade on a read-only basis only; we do not solicit, recommend or execute securities or commodities transactions.
9.4 Canada
The Content is not directed at residents of any Canadian province or territory and does not constitute an offer to sell or a solicitation to buy securities in Canada. We are not registered as a dealer, adviser or investment-fund manager in any Canadian jurisdiction.
9.5 Australia
The Content is general information only and does not take into account your objectives, financial situation or needs. It is not a “financial product advice” service under the Corporations Act 2001 (Cth). Before acting on any information you should consider its appropriateness for you and read any relevant Product Disclosure Statement.
9.6 Other jurisdictions
Where local law in your jurisdiction would impose additional licensing, registration, translation or disclosure requirements on the Content, access to the Service in that jurisdiction is not authorised. If you believe the Service is reaching residents of a jurisdiction in which it should not be available, please contact us at support@marketrecapdaily.com so we can apply geofencing or restrict access.
10. Limitation of liability
To the maximum extent permitted by law, Market Insight, its operator, and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with the Service.
Our total aggregate liability for any claim arising out of the Service is limited to the greater of (a) the amounts you paid us in the 12 months preceding the claim, or (b) GBP 100. Nothing in these Terms excludes liability that cannot be excluded under UK law (such as for death or personal injury caused by negligence, or for fraud).
11. Indemnity
You agree to indemnify and hold Market Insight harmless from any third-party claim arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
12. Termination
You may stop using the Service at any time and delete your account from the settings page. We may suspend or terminate your access if you breach these Terms or if continuing to provide the Service becomes commercially or legally impractical. On termination, your brokerage connections via SnapTrade are revoked and cached data is removed within 30 days, except where retention is required by law.
13. Changes to the service or terms
We may modify or discontinue features of the Service at any time. We may also update these Terms; material changes will be notified at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, save that consumers may bring proceedings in the courts of their country of residence where required by law.
